Privacy Policy below governs CUSTOMERs NavSoft RacePro account and
any information CUSTOMER provides on this site.

General
This Privacy Policy describes the information NavSoft collects and
how NavSoft uses that information. NavSoft takes the privacy of
CUSTOMERs personal information very seriously and will use CUSTOMERs
information only in accordance with the terms of this Privacy Policy.
NavSoft will not sell or rent CUSTOMERs information or distribute
a list of customers to third parties.There are limited circumstances
in which some of CUSTOMERs information will be shared with third
parties, under strict restrictions, so it is important for CUSTOMER
to review this Privacy Policy. This Privacy Policy applies to all
services that are hosted on the NavSoft website.
NavSoft
uses the Universal Credit services for billing and invoicing. In
order to operate the NavSoft service and to reduce the risk of fraud,
CUSTOMER must provide to Universal Credit information about CUSTOMER
and CUSTOMERs credit or debit card and/or bank account. Therefore
the Universal Credit Privacy Policy is applicable.
Privacy
By accepting the Privacy Policy and User Agreement in registration,
CUSTOMER expressly consents to NavSoft's use and disclosure of CUSTOMERs
personal information in the manner described in this Privacy Policy.
This Privacy Policy is incorporated into and is subject to the terms
of the NavSoft RacePro User Agreement. CUSTOMERs personally identifiable
information will be stored and processed on NavSoft's computers.
NavSoft will hold and transmit CUSTOMERs personal information in
a safe, confidential and secure environment. If CUSTOMER objects
to CUSTOMERs personal information being transferred or used as described
in this Privacy Policy, please do not register for the NavSoft RacePro
service.
Notification
of changes
This policy may be revised over time as new features are added to
the NavSoft RacePro service or as NavSoft incorporates suggestions
from NavSoft's customers. When NavSoft is going to use or disclose
CUSTOMERs personally identifiable information in a manner materially
different from that stated at the time NavSoft collected the information,
CUSTOMER will have a choice as to whether or not NavSoft can use
or disclose CUSTOMERs information in this new manner. NavSoft will
post the amended privacy policy prominently on the NavSoft website
so that CUSTOMER can always review what information NavSoft gathers,
how NavSoft might use that information, and whether NavSoft will
disclose it to anyone.
Third
parties
Some pages on the NavSoft website include links to third party Websites.
These sites are governed by their own privacy statements, and NavSoft
is not responsible for their operations, including but not limited
to their information practices. Users submitting information to
or through these third party Websites should review the privacy
statement of these sites before providing them with personally identifiable
information.
Required
information
To open a NavSoft RacePro account, CUSTOMER must provide CUSTOMERs
name, address and email address. In order to receive simulations,
CUSTOMER must provide credit card, debit card and/or bank account
information through Universal Credit.
Correspondence
If CUSTOMER sends NavSoft correspondence, including emails and faxes,
NavSoft retain such information. NavSoft will also retain customer
service correspondence and other correspondence from NavSoft to
CUSTOMER. NavSoft retains these records in order to measure and
improve NavSoft's customer service, and to investigate potential
fraud and violations of NavSoft's User Agreement. NavSoft may, over
time, delete these records if permitted by law. NavSoft may offer
optional questionnaires and surveys to NavSofts users for such purposes
as collecting demographic information or assessing users' interests
and needs. The use of the information collected will be explained
in detail in the survey itself. NavSoft uses the information NavSoft
collects about CUSTOMER in order
1) to provide NavSoft's services and process CUSTOMERs transactions,
2) to provide customer service,
3) to determine CUSTOMERs eligibility to receive offers for special
features or products, and
4) to improve NavSoft's products and services.
At
CUSTOMERs option, NavSoft may use the information CUSTOMER provides
to access specific third party services on CUSTOMERs behalf and
perform the actions that CUSTOMER request NavSoft to perform. NavSoft
gives access to individually identifiable information about NavSoft's
users only to those employees who require it to fulfill customer
service requests. CUSTOMERs name, email address, date of sign-up,
and NavSoft account number may be displayed to other NavSoft customers.
However, CUSTOMERs credit card number, bank account details and
other financial information will NEVER be revealed to anyone whom
CUSTOMER has paid or who has paid CUSTOMER through NavSoft, except
if we are required to do so by law.
NavSoft will not sell or rent any of CUSTOMERs personally identifiable
information to third parties. NavSoft will not share any of CUSTOMERS
personally identifiable information with third parties except in
the limited circumstances described below, or with CUSTOMERs express
permission (and to other NavSoft customers as described above).
These third parties are limited by law or by contract from using
the information for secondary purposes beyond the purposes for which
the information is shared. NavSoft may share information with companies
that help NavSoft process the transactions CUSTOMER request and
protect NavSofts customers' transactions from fraud, such as sharing
CUSTOMERs credit card number with a service that screens for lost
and stolen card numbers.
NavSoft
may disclose the information NavSoft collects, as described above,
to companies that perform marketing services on NavSoft's behalf
or to other financial institutions with which NavSoft have joint
marketing agreements. These companies are subject to confidentiality
agreements with NavSoft and other legal restrictions that prohibit
use of the information except to market the specified NavSoft-related
products or services, unless CUSTOMER have affirmatively agreed
or given CUSTOMERs prior permission for other uses. NavSoft may
disclose information in response to requirements of civil or criminal
legal process.
NavSoft
may share aggregated statistical data with NavSoft's business partners
or for public relations. However, this aggregated information is
not tied to personal information.
As
with any other business, it is possible that NavSoft in the future
could merge with or be acquired by another company. If such an acquisition
occurs, the successor company would have access to the information
maintained by NavSoft, including CUSTOMERs account information,
but would continue to be bound by this Privacy Policy unless an
until it is amended as described above. NavSoft may share CUSTOMERs
information with NavSoft's parent, subsidiaries and joint ventures
to help coordinate the services NavSoft provides to CUSTOMER, enforce
NavSoft's terms and conditions, and promote trust and safety.
Contacts
NavSoft may communicate with CUSTOMER on a regular basis via email
to provide requested services, and NavSoft may also communicate
by phone to resolve CUSTOMERs complaints or investigate suspicious
transactions. NavSoft may use CUSTOMERs email address to confirm
CUSTOMERs opening of a NavSoft account, to send information about
important changes to NavSofts products and services, and to send
notices and other disclosures required by law. Generally, CUSTOMER
can not opt out of these communications, but they will be primarily
informational in nature rather than promotional. NavSoft may also
use CUSTOMERs email address to send CUSTOMER other types of communications
that CUSTOMER can control, including a NavSoft Periodical newsletter,
customer surveys and notice of special third-party promotions.
Internet
information
NavSoft may use IP addresses, browser types and access times to
analyze trends, administer the site, improve site performance and
gather broad demographic information for aggregate use. In order
to facilitate the phone connection between NavSoft members, NavSoft's
service allows CUSTOMER limited access other users' contact or delivery
information. By entering into NavSoft's User Agreement, CUSTOMER
agrees that, with respect to other users' personally identifiable
information that CUSTOMER obtains through the site or through an
NavSoft-related communication or NavSoft-facilitated transaction,
CUSTOMER will only use this information for:
(1) NavSoft-related communications that are not unsolicited commercial
messages,
(2) using services offered through NavSoft (e.g. insurance, delivery
and fraud complaints), and
(3) any other purpose that such user expressly agrees to after adequate
disclosure of the purpose(s).
In
all cases, CUSTOMER must provide users with the opportunity to remove
themselves from CUSTOMERs database and review any information CUSTOMER
has collected about them. In addition, under no circumstances, except
as defined in this Section, can CUSTOMER disclose personally identifiable
information about another NavSoft user to any third party without
NavSoft's consent and the consent of NavSoft's other user after
adequate disclosure. Note that law enforcement personnel and other
rights holders are given different rights with respect to information
they access.
Spam
Policy
CUSTOMER may not add a NavSoft user to CUSTOMERs mail list (email
or physical mail) without their express consent after adequate disclosure,
even if said user has previously made a purchase from CUSTOMER.
To report NavSoft-related spam to NavSoft, please contact NavSoft.
Information
security
NavSoft is committed to handling CUSTOMERs information with high
standards of information security. CUSTOMERs credit card and/or
bank account information are stored only in encrypted form on Universal
Credit's computers that are not connected to the Internet. NavSoft
restricts access to CUSTOMERs personally identifiable information
to employees who need to know that information in order to provide
products or services to CUSTOMER. NavSoft maintains physical, electronic
and procedural safeguards that comply with regulations to guard
CUSTOMERs non public personal information. The security of CUSTOMERs
NavSoft account also relies on CUSTOMERs protection of CUSTOMERs
NavSoft password and pin-code. CUSTOMER may not share CUSTOMERs
NavSoft password and/or pin-code with anyone. NavSoft representatives
will never ask CUSTOMER for CUSTOMERs password or pin-code, so any
email or other communication requesting CUSTOMERs password and/or
pin-code should be treated as unauthorized and suspicious. If CUSTOMER
does share CUSTOMERs NavSoft password and/or pin-code with a third
party for any reason, including because the third party has promised
to provide CUSTOMER additional services, the third party will have
access to CUSTOMERs account and CUSTOMERs personal information,
and CUSTOMER may be responsible for actions taken using CUSTOMERs
password and/or pin-code. If CUSTOMER believes someone else has
obtained access to CUSTOMERs password and/or pin-code, CUSTOMER
should change it immediately by logging in to CUSTOMERs account.
Accessing
CUSTOMERs information
CUSTOMER can review the personal information CUSTOMER provided NavSoft
and make any desired changes to such information, or to the settings
for CUSTOMERs NavSoft account, at any time by logging in to CUSTOMERs
account on the NavSoft website and changing CUSTOMERs preferences.
CUSTOMER can also close CUSTOMERs account through the NavSoft website.
If CUSTOMER closes CUSTOMERs NavSoft account, NavSoft will mark
CUSTOMERs account in NavSofts database as "Closed," but
will keep CUSTOMERs account information in NavSofts database. This
is necessary in order to detect fraud, by ensuring that persons
who try to commit fraud will not be able to avoid detection simply
by closing their account and opening a new account. However, if
CUSTOMER closes CUSTOMERs account, CUSTOMERs personally identifiable
information will not be used by NavSoft for any further purposes,
nor sold or shared with third parties, except as necessary to prevent
fraud and assist law enforcement, or as required by law.
Accountability
NavSoft is responsible for ensuring that day-to-day procedures comply
with this Privacy Policy. If CUSTOMER has any questions about this
privacy statement, NavSoft's information practices, or CUSTOMERs
dealings with NavSoft, CUSTOMER can contact NavSoft at the following
